Agreement Between User and the Adelaide University Dental Student Society (AUDSS)

The AUDSS Website is available to you in the acceptance without modification of the terms, conditions, and notices contained herein. Your use of the AUDSS WebSite constitutes your agreement to all such terms, conditions, and notices.

Modification of these Terms of Use

The AUDSS reserves all right to modify any terms, conditions, and notices contained herein the AUDSS Website, where deemed appropriate by the AUDSS body.

Links to Third Party Sites

The AUDSS Website contains links to other Third Party Websites. Such Websites are not under the control of the AUDSS (unless otherwise stated) and the AUDSS assumes no responsibility for the content provided in such Websites; including without limitation any link to other websites or any changes or updates. The AUDSS provides links as means of convenience, and such link does not imply endorsement by the AUDSS or its committee. 

No Unlawful of Prohibited Use

By using the AUDSS Website, you agree to the condition that you will not use the AUDSS WebSite for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the AUDSS WebSite in any manner which could damage, disable, overburden, or impair the AUDSS as an organisation, nor interfere with any other party's use and enjoyment in the AUDSS website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the AUDSS WebSites. Any such action may result in expulsion from the AUDSS, and/or the appropriate prosecution.

Use of Communication Services

The AUDSS Website will contain in it commenting systems, and methods in which users may communicate with each other. Communication within these platforms is provided as a service aimed towards allowing community contribution. You agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.

The AUDSS is under no obligation to monitor posts made on communication services. However, the AUDSS reserves the right to view any messages sent using the services provided, as well as revoking the privileges of any user who violates the terms and conditions set.

The AUDSS reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the AUDSS's sole discretion.

The AUDSS specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service.

Managers and hosts are not authorized AUDSS spokespersons, nor spokepersons of The University of Adelaide School of Dentistry, and their views do not necessarily reflect those of the AUDSS, or the Adelaide University Dental School. 

Materials Provided to the AUDSS or Posted at any AUDSS Web Site

The AUDSS does not claim ownership of the materials you provide to AUDSS (including feedback and suggestions) or post, upload, input or submit to any AUDSS Website or its associated services . However, by posting, uploading, inputting, providing or submitting your Submission you are granting the AUDSS, its affiliated committees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

Termination/Access Restriction

The AUDSS reserves the right, in its sole discretion, to terminate your access to the AUDSS WebSite and the related services or any portion thereof at any time, without notice.

General

To the maximum extent permitted by law, this agreement is governed by the laws of the Australia and you hereby consent to the exclusive jurisdiction and venue of courts in Australia in all disputes arising out of or relating to the use of the AUDSS WebSite. Use of the AUDSS WebSite is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and the AUDSS as a result of this agreement or use of the AUDSS WebSite. AUDSS's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of AUDSS's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the AUDSS WebSite or information provided to or gathered by the AUDSS with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Privacy Policy

For each visitor to the AUDSS website, the web server does not recognise any information regarding the domain or email address.

The AUDSS website collects only payment information (e.g., credit card number and billing address) that is volunteered by customers, and any other relevant information that is required by the AUDSS to successfully process any orders placed by customers. Such information is private and not disclosed to any third party.

The information collected is disclosed when legally required to do so, at the request of governmental authorities conducting an investigation to verify or enforce compliance with the policies governing our website and applicable laws or to protect against misuse or unauthorized use of our website.

The AUDSS do not make the customer email list available to other organisations.

If you supply the AUDSS with your postal address on-line you will only receive the information or product for which was the purpose of provided your address to the AUDSS.

With respect to Ad Servers: the AUDSS do not partner with or have special relationships with any Ad Server companies.

Consumers may have this information corrected by contacting the AUDSS.

With respect to security: the AUDSS have appropriate security measures in place within physical facilities to protect against the loss, misuse or alteration of information that the AUDSS have collected from you at the AUDSS website. In this regard, please observe the SSL certificate evidencing the guarantee of an independent party that the online payment service is secure.

AUDSS Media Policy

By adhering to the media policy, you agree to the following;

1.      Consent to the use, publication and reproduction of photographs and videos of me, by the Adelaide University Dental Student Society (AUDSS), for the purposes of advertising, media publicity, general display or for any other purposes in whole or in part.

2.      Agree that the use, publication or reproduction of aforementioned photographs and videos may occur by any medium, including, but not limited to magazines, brochures, promotional content on websites, including social media outlets.

3.      Agree that the rights granted to AUDSS under this Media Policy are perpetual and waive any interest in the copyright to said photographs and videos, now or at any future time.

4.    Acknowledge that I do not expect to receive any payment or any other consideration in connection with the taking, use or storage of the photographs and video. 

5.      Acknowledge and agree that any use of the photographs and video is, at the date of publication, made in good faith and is not intended to defame, offend, or bring my reputation into disrepute.

6.      Release AUDSS from any liability (including consequential loss) connected with the publication, reproduction, or release of the photographs and video.

Events and Alcohol Policy

Adelaide University Dental Student Society (AUDSS)

Alcohol and Antisocial behaviour Standard.

Purpose: To minimise risk and enhance safety and enjoyment for all AUDSS members, dental and oral health students and others attending AUDSS functions.

  1. Antisocial behaviour (i.e. verbal abuse, physical abuse, damage to goods or property) will not be tolerated at AUDSS events.

  2. In the event of antisocial behaviour the AUDSS Core Executives (President, Vice President, Secretary and Treasurer) and Event Executive Officers have the discretion to decide whether or not it is appropriate for the offending individual/s to remain at or to leave the AUDSS event.

  3. Individuals may not be permitted entry at all AUDSS-related events, and written notice of this action will be given to the offending party and the School of Dentistry Dean.

  4. Grievances may be raised to the AUDSS President, School of Dentistry or to the University of Adelaide Education and Welfare Officers. AUDSS will run a variety of events throughout the calendar year. At events where alcohol will be served: 

  5. Alcohol will be served either by qualified employees of the venues attended by the AUDSS, or by AUDSS Committee Members who have completed Responsible Service of Alcohol training (RSA). -­‐ Water (available free) and non-alcoholic drinks will be readily available.

  6. -­‐ Alcohol will not be served to minors (below 18 years of age). -­‐

  7. Alcohol will not be served to individuals who are behaving in an antisocial manner (as above), appear to be intoxicated (their speech, balance, coordination or behaviour is noticeably impaired and it is reasonable to believe the impairment is the result of the consumption of liquor), or if it is believed that the individual is planning to drive a motor vehicle and may be over the legal alcohol limit.

  8. It is not the responsibility of the AUDSS or its Committee to regulate an individual’s alcohol consumption.  Recognising, however, that young adults 18 – 25 years and under 18s are at greater risk from drinking alcohol AUDSS strongly recommends the “Australian guidelines to reduce health risks from drinking alcohol”(1) be followed  • For healthy men and women, drinking no more than two standard drinks on any day reduces the lifetime risk of harm from alcohol-related disease or injury. • For healthy men and women, drinking no more than four standard drinks on a single occasion reduces the risk of alcohol-related injury arising from that occasion.  • Young people (up to 18 years of age) are advised not to drink alcohol at all.

AUDSS defines sexual assault as:

  • unwanted sexual touching or fondling

  • unwanted kissing

  • rape

  • indecent assault

The University of Adelaide defines sexual harassment as:

  • commenting on a person's appearance

  • comments, jokes or name-calling

  • leering or staring

  • sexual pictures, objects, emails, text messages or literature

  • direct or implied propositions, or requests for dates

  • asking about a person's sexual history or sexual activities.

Ignorance is not a defence for sexual harassment or assault.

Please be aware that all ticket holders agree to the AUDSS Events and Alcohol Policy when purchasing events tickets.

What can you do if you are sexually harassed or assaulted at an AUDSS event? What happens from there?

  • Reports submitted may be seen by the AUDSS Incident Report Committee (AUDSS President, Vice-President, Incident Report Officers, and Events Executive Officers).

  • The offending party/parties will be emailed if you consent for them to be contacted and for the implementation of the AUDSS Behaviour Matrix.

  • The offending party/parties will have a meeting with the Incident Report Committee within 48 hours of being emailed by the Incident Report Committee.

  • Disciplinary action will be made on a case-by-case basis, using AUDSS Behaviour Matrix as a guide.

  • YouX and the Dean of Adelaide Dental School will be notified of the report and outcome.

  • AUDSS IT executive officer and Events General committee will be notified of any bans.

Grievances may be raised with the AUDSS President, School of Dentistry or with the University of Adelaide Education and Welfare Officers.

  4. Alcohol will not be served to minors (below 18 years of age) and the AUDSS Committee has the right to refuse serving alcohol to individuals who are behaving in an antisocial manner (as above), appear to be intoxicated (their speech, balance, coordination or behaviour is noticeably impaired and it is reasonable to believe the impairment is the result of the consumption of liquor), or if it is believed that the individual is planning to drive home afterwards and may be over the legal alcohol limit.
